What is TRC in Poland ?

A foreigner must get a temporary residency permit (TRC) in order to legally remain in Poland for a duration longer than three months. When state officials make a favorable decision, the foreigner receives an official document called a residence card (temporary residence card). The document's maximum validity duration is three years. The rationale for granting the permit will, however, determine this time frame.

Foreigners with Polish temporary residency cards are permitted to spend up to 90 days out of every 180 days in the Schengen area, which includes the other 28 EU member states in addition to Poland for a total of 360 days each year.

WHO can apply for TRC based on business activity

Foreign nationals may be given this temporary residence visa provided they can provide the following reasons for their presence in Poland:

Foreigner conducts business activity in Poland

• Foreigner serves on the management board of LLC in Poland
• Foreigner serves on the management board of Joint-Stock Company whose shares or stocks he/she owns
• Foreigner manages the affairs of a Limited Partnership or a Limited Joint-Stock Partnership by a general partner
• Foreigner acts as a procurator

Business residence permit in Poland

If you want to obtain a Temporary residence permit (residence card etc.) in Poland you will have to:

• arrive to Poland on the basis of a visa - (generally speaking, you have to arrive in Poland on a legal basis - business visa or tourist visa)
• have a place of residence in Poland e.g. on the basis of a lease agreement;
• have health insurance - it can be simply bought in Poland

In order to obtain a business residence permit in Poland, your company has to be “active”. Generally speaking, we have to demonstrate that your company is beneficial to the Polish economy by contributing to an increase in investment, transfer of technologies, the introduction of beneficial innovations, and job creation.

Conditions which ensure obtaining residence permit in Poland

Above mentioned condition about demonstrating that your company is beneficial to the Polish economy is very general – the decision is based on the discretionary decision of the Immigration Office.

However, there are conditions that guarantee you obtain a residence permit in Poland. Under Polish Foreigners Act, you will obtain a residence permit if your company:

in the tax year preceding the filing of the application for granting the foreigner a temporary stay permit for the purpose of pursuing economic activity by the foreigner, earned income of no less than 12 times the average monthly remuneration, valid on the day of filling the application, in the voivodeship in which such subject has its seat or place of residence, said average monthly remuneration being announced by the President of the Central Statistical Office pursuant to Article 30, paragraph 2 of the Act of 26 October 1995 on some forms of support for housing industry (Dziennik Ustaw 2017, item 79 and 1442) or employs, for an indefinite period and on a full-time basis, at least for the period of 1 year preceding the filing of the application, at least two employees who are Polish citizens or foreigners referred to in Article 87, paragraph 1, subparagraphs 1 to 9 of the Act of 20 April on Employment Promotion and Labour Market Institutions.

Therefore shareholders of a Polish company will obtain an (obligatory) residence permit in Poland if:

• Polish company is employing at least two Polish citizens;
• The yearly income of the company will be around PLN 50.000 – around USD 14.000

You have to be advised, that motion to obtain a residence card in Poland has to be filed on the last day of your legal stay in Poland. Usually, the procedure lasts around 3 months, however, it can last much longer and usually last.

The important note has to be noted that during the procedure of obtaining a residence permit you are entitled to stay in Poland regardless of visa's expired date.
