Why Immigration office rejects TRC applications and what are the chances to get residence after appeal?

Year to year Immigration Offices in Poland is issuing more and more positive decisions to the applicants. Just see the statistics:

  • In 2017 – 103 220 people

  • In 2018 – 114 036 people
  • In 2019 – 139 340 people
  • In November 2020 – 123 985 people

The amount of applications is growing. It means that Poland is a very potential country for foreigners in building future here.

On the other side is the amount of negative decisions which is growing as well:

  • In 2017 – 12 567 people
  • In 2018 – 26 908 people
  • In 2019 – 32 840 people
  • In November 2020 – 33 941 people

We expect that in 2020 total amount of negative decisions will be 35 400.

Anyway, we want to secure those people who are applying for their Temporary Residence Card in Poland. Let’s check why people are getting refusals:

1. Documents that are missing

It indicates that you have not submitted your paperwork on time or that they do not meet the requirements of the Office of Foreigners.

Following the submission of any official deficiencies (such as fingerprints, passports, attachment nr. 1, and photos), you will often receive a letter with a summons, which you must submit within a specified time frame. If you ignore it, they can quickly make a bad decision.

2. University or Employer is blacklisted

It means your application is linked to them, and they are currently stuck in the system, unable to be accepted by the Immigration Office.

The government may issue orders to inspect educational institutions' licensing on occasion. Universities that do not renew their licenses on time endangering their pupils.

3. Illegal stay

It indicates that you submitted a TRC application while in Poland illegally. It happens frequently when people receive a rejection, file an appeal, and then apply again after a period of time without checking if the previous case is still active. They may fall into a trap if they submit a new case based on an existing one that has already been resolved.

4. Police couldn’t check your place of living

It indicates they couldn't find your address in their database. It's possible that you mentioned the incorrect postal code. It can actually pose complications because the immigration office is so overburdened that they don't have much time to invite people for an address change. You must take care of yourself.

5. No strong reason to stay in Poland

When a justification for stay expires, something happens. For example, students in their final semester wish to apply for TRC but are denied owing to their short study duration. In such instances, it is preferable to submit a Job Search TRC application right away. Employees whose contracts are about to end are in the same boat.

Do not be concerned if you receive a bad decision. Currently, the appeals are considered by the Head Office (located at Taborowa 33 in Warsaw) within 3-7 months. To give you an idea, the appeal procedure in 2018-2019 might take up to 24 months. They are now working hard to rebuild the foreigner's head office system.

Almost 90% of cases which are refused from Immigration Office have chances to be finished with the positive decision in Head Office. For that, you have to prepare an appeal letter with strong arguments and your personal position. You have to attach all the needed original paper proofs to convince Immigration Office and submit it to Immigration Office which has issued you the positive decision. Do not forget to submit 2 copies of the appeal letter.

Since November 2020 Head Office implemented SMS notifications for the applicants. They will inform you by SMS that your appeal is accepted and considered in 2-3 weeks after its submission.
